DMCA & Copyright Policy

How copyright owners can report material and how affected publishers can respond.

Our approach to copyright

SMSX respects the intellectual-property rights of others and expects users and contributors to do the same. This policy explains how copyright owners can notify us of material they believe infringes their rights, and how affected parties can respond.

This policy is designed to align with the notice-and-takedown framework of the U.S. Digital Millennium Copyright Act (DMCA) and comparable principles in other jurisdictions. It is provided for general information and is not legal advice.

Trademark concerns — for example a brand name or logo used in a way you believe is misleading — can be sent through the same address, clearly labelled as a trademark complaint.

Submitting a copyright complaint

If you are a copyright owner, or authorized to act on behalf of one, and believe material on SMSX infringes your copyright, send a written notice to support@smsx.app with the subject line "Copyright Notice".

What an effective notice contains

  • Your physical or electronic signature.
  • Identification of the copyrighted work you claim has been infringed.
  • The exact URL and a description of the material you want removed.
  • Your contact information, including name and email, and where relevant an address and phone number.
  • A statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf.

Before you send

Incomplete notices may delay our review. Please do not send notices for material you do not own or are not authorized to represent, and please check that the URL you cite is on this website rather than on a site that merely resembles it.

What we do after a valid notice

When we receive a complete and good-faith notice, we will review it and, where appropriate, remove or disable access to the identified material. We may also notify the party who provided the material, where one exists and can be identified.

We may decline to act on notices that are incomplete, appear abusive, or clearly do not concern copyright, and we may ask for clarification before taking action. Where a complaint would be handled better as a privacy or safety matter, we will point you to the removal process instead.

Filing a counter-notice

If you believe material of yours was removed by mistake or misidentification, you may submit a counter-notice.

  • Your signature, physical or electronic.
  • Identification of the removed material and the location where it previously appeared.
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • Your contact information and consent to the jurisdiction of the appropriate courts, as required by applicable law.

Where to send it

Send counter-notices to support@smsx.app with the subject line "Copyright Counter-Notice". Filing a false counter-notice may carry legal consequences, so consider seeking legal advice if you are unsure.

Repeat infringers and misuse

We may, in appropriate circumstances and at our discretion, restrict or terminate access for users or contributors who are found to be repeat infringers.

Submitting knowingly false claims of infringement — whether in a notice or a counter-notice — is prohibited and may result in liability under applicable law.
